We're finalizing this document ahead of launch, so it may change. If it changes in a way that affects you, we'll let you know. Questions? Email info@bizbie.com.
1. Who we are and what these terms cover
These Terms and Conditions ("Terms") form a binding agreement between you and Bizbie Inc., operating as Bizbie ("Bizbie", "we", "us"). Bizbie is a federally incorporated Canadian company with its registered office at 22524 Highway 37, Sturgeon County, Alberta T8L 5A5. These Terms govern your use of the Bizbie website (bizbie.com), the Bizbie mobile app, and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What Bizbie is
Bizbie is a marketplace for businesses in your community. People use Bizbie to find goods, services and venues by what they need, buy them in the app, and recommend what they bought. Businesses use Bizbie to list what they sell and reach customers in their community.
Bizbie is a platform. We do not make or provide the goods or services that businesses list, and we are not the seller in any purchase from a business. We are a party to: (a) paid profiles and add-ons that businesses buy from us, and (b) the service fee that buyers pay to us at checkout.
Bizbie is currently available in Canada only.
3. Who can use Bizbie
You must be at least 16 years old to create a Bizbie account. By creating an account, you confirm that you meet this requirement. If we learn that an account belongs to someone under the minimum age, we will close it and delete the associated personal information, subject to our legal obligations.
4. Accounts
There are three kinds of account: Community Member, Business Owner and BizRep. Every account can search, browse, buy, recommend, and use the community feed.
You must give accurate information and keep your login details confidential. You are responsible for everything that happens under your account. Tell us promptly at info@bizbie.com if you think someone has accessed your account without permission.
You may have one personal account. A business must be registered by someone who owns the business or is authorized to act for it.
5. Who can list on Bizbie
Bizbie is for independent businesses, makers and service providers in the communities they serve. Large chains are not eligible.
Before a business can publish listings, its BizRep verifies the owner's identity and the business's documents. We decide eligibility and may ask for evidence of ownership, registration or where the business operates. We may refuse, hide or remove any business or listing that does not meet this standard. That includes a business that stops responding or appears to have stopped trading.
6. Listings, search and sponsored placements
Each product, service, space or event is listed on its own. Search results show listings, not business profiles. They are based on what you searched for and the area you're searching in.
Some listings appear in clearly labelled "Sponsored" placements. Sponsored placements are paid. They never change the order of search results, and they do not affect recommendations. Sponsored content is always labelled.
You can hide listings you're not interested in. When a listing sells out, it is marked "Sold Out".
7. Buying on Bizbie
7.1 How purchases work
When you buy through Bizbie, you buy from the business, not from Bizbie. Payments are processed by Stripe. The business is paid through its own Stripe account, and Bizbie takes 0% of the business's sale price.
At launch, orders are picked up from the business. Delivery and shipping terms will be added when those options are available.
7.2 Service fee
A service fee of 6% of the order value plus $0.35 is added at checkout and paid to Bizbie. The fee is always shown before you pay. If an order is cancelled or fully refunded, the service fee is refunded too.
7.3 Refunds and cancellations
Each business chooses its refund and cancellation policy from a set of options Bizbie provides. The policy is shown before you pay and is locked at the time of purchase. A business cannot change the policy that applied to a completed purchase.
7.4 Your legal rights
Nothing in these Terms limits any rights you have under the consumer protection laws of the province or territory where you live. If a refund policy conflicts with those laws, the law applies.
7.5 Problems with an order
Bizbie can help buyers and businesses communicate, including through in-app messaging. The business is responsible for the quality, safety and fulfilment of what it sells.
8. Business profiles, paid profiles and add-ons
8.1 Free profiles
Every business can create a profile and listings for free, and can stay on a free profile for as long as it likes. A free profile does not include selling through Bizbie, receiving recommendations, or in-app messaging.
While a business is on a free profile, shoppers can send it a "Nudge" to let it know someone wants to buy.
8.2 Paid profiles
To sell through Bizbie, receive recommendations and use in-app messaging, a business must upgrade to a paid profile. Paid profiles become available when Bizbie opens selling to customers in the app. Until then, no business is charged anything.
8.3 Founding Businesses
Businesses can pre-register for a Founding Business spot. Spots are limited to the first 3,333 businesses. Pre-registering is free and does not commit you to pay.
When paid profiles become available, pre-registered businesses are invited to upgrade. A Founding Business pays a base rate of $10 CAD per month, plus applicable taxes, for as long as it stays subscribed. That base rate will not increase while the subscription continues.
If a Founding Business cancels, or its subscription ends for non-payment, it loses its Founding status and base rate permanently. They cannot be reclaimed.
8.4 Standard paid profiles
After the Founding spots are filled, paid profiles are offered at the standard rate shown in the Service.
8.5 Add-ons
Businesses on a paid profile can add optional features for an extra monthly fee, shown before purchase. For Founding Businesses, add-ons start from $2 CAD per month. Add-ons can be removed at any time and stop renewing at the end of the paid month.
8.6 Billing, renewal and cancellation
- Billing starts only when a business chooses to upgrade to a paid profile. It never starts automatically from a free profile or a pre-registration.
- Paid profiles and add-ons are billed monthly and renew automatically until cancelled. You will always be shown the price and that it renews monthly before you upgrade.
- You can cancel at any time from your account settings. Cancelling stops future charges. Your paid features stay active until the end of the month you've paid for.
- Fees are non-refundable, including for a partly used month, except where the law requires a refund.
- We will give at least 30 days' written notice of any price change before it applies to you. A price change never affects a Founding Business's locked base rate while it stays subscribed.
9. Recommendations and feedback
9.1 Only buyers can recommend
Only someone who has completed a verified purchase through Bizbie can recommend a listing. Each purchase unlocks one recommendation. The option does not appear until the purchase is complete.
9.2 Recommendations belong to the listing
A recommendation or piece of feedback attaches to the specific listing that was bought, not to the business as a whole. A listing nobody has bought through Bizbie yet shows "No recommendations yet".
9.3 How it works
- Within 48 hours after a verified purchase, Bizbie asks the buyer one question: would you recommend this to your friends? The buyer answers yes or no. There are no star ratings.
- If the buyer answers yes, they can add a comment, and can share it as a post with photos, linked to the listing they bought.
- If the buyer answers no, Bizbie asks how the business could improve that listing. The feedback goes to the business owner. The buyer can also choose to share it publicly as a post, so other buyers can see it.
- Sharing anything as a post is always the buyer's choice.
- Public recommendations and feedback show the buyer's first name and last initial, the date, and that the purchase was verified.
- We do not edit what buyers write. We may remove content that breaks these Terms, contains someone else's personal information, or is unlawful.
The option to recommend closes 48 hours after the purchase is complete.
9.4 What's not allowed
You must not: - recommend or give feedback on a listing from a business you own, operate or work for; - buy from a business in order to recommend it where you have a financial or personal arrangement with that business; - offer or accept payment, free goods or any other benefit in exchange for a recommendation; - post anything false or misleading, or that you don't believe.
We block business owners and employees from buying their own listings. We may investigate, remove content from, and close accounts that appear to be connected to a business for the purpose of recommending it.
9.5 BizRep purchases and recommendations
A BizRep can buy from a business they earn commission from, like any other customer. BizReps earn no commission on their own purchases.
A BizRep can recommend a listing they bought. Because BizReps earn commission from other people's purchases at the businesses they represent, their recommendations of those businesses are always shown with a clear label saying they are the business's BizRep.
9.6 Disputes
A business may dispute a recommendation or feedback post it believes breaks these Terms: 1. The business submits a dispute through the Service within 30 days of the post, explaining which part of these Terms it breaks and providing any evidence. For example, the buyer is connected to the business, or did not buy the listing. 2. Bizbie tells the buyer and gives them 7 days to respond. 3. A Bizbie team member who did not sign up or manage the business reviews the dispute. If the business is connected to a BizRep, the reviewer has no commission connection to that BizRep. 4. We remove a post only if it breaks these Terms, for example a self-purchase, a financial connection, a false claim of purchase or unlawful content. We will not remove a post just because the business disagrees with it. 5. We tell both sides the outcome and the reasons in writing, within 14 days where possible. 6. Decisions are final within the Service. This does not limit your legal rights.
The Competition Act prohibits fake and misleading reviews. We take this seriously and may report conduct that appears to break it.
10. BizReps
BizReps are independent representatives who sign up businesses, verify owners and their documents, and stay the business's contact at Bizbie. BizReps are not Bizbie employees. - BizReps earn commission on Bizbie's revenue from the businesses they sign up. Commission is never earned on recommendations or feedback, or on a BizRep's own purchases. - Each BizRep's profile has a "My businesses" section listing every business they earn commission from, with an explanation of that commission. Each listing represented by a BizRep shows a label saying the BizRep earns commission there, with a link to that explanation. - A BizRep must disclose this commission whenever they promote a business they earn from. Their recommendations of those businesses carry a BizRep label (see section 9.5). - BizReps must not offer incentives for recommendations or make false claims about Bizbie or any business. They must follow the BizRep Agreement.
The full terms for BizReps are in the BizRep Agreement, which forms part of these Terms for BizReps.
11. Location and hubs
Bizbie shows businesses within a radius of the area you choose. Sharing your device location is optional. - Your home area is called your Home Hub. You can change it at any time. - You can switch to another area, for example when travelling, and switch back to your Home Hub. - We keep a list of locations you save so the Service works as intended. You can remove any saved location, including with "forget this location". - If you don't share your location, results are less precise.
See our Privacy Policy for how we handle location information.
12. Your content
You keep ownership of what you post, such as recommendations, feedback, photos, posts and comments ("Your Content"). By posting it, you give Bizbie a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and adapt it to run and promote the Service. This licence ends when you delete the content, except where it has already been shared or copied within the Service.
You are responsible for Your Content and confirm you have the right to post it.
13. Acceptable use
You must not: - use the Service for anything unlawful; - impersonate any person or business; - scrape or collect data from the Service other than through features we provide; - interfere with the security or operation of the Service; - use automated tools to create accounts, recommendations or purchases; - post harmful, threatening, discriminatory or sexually explicit content; - post anyone's personal information without their consent.
We may suspend or close accounts that break these rules.
14. Intellectual property
Bizbie's name, logo, software and content (other than Your Content) belong to us or our licensors. You may not copy, modify or use them without our written permission.
15. Third-party services
The Service uses third-party services, including Stripe for payments and identity verification, and map providers. They have their own terms and privacy policies, and we are not responsible for them.
16. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promise that the Service will be uninterrupted or error-free, or that listings, recommendations or businesses are accurate or suitable for your purposes.
17. Limitation of liability
To the fullest extent the law allows, Bizbie is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill arising from your use of the Service. Our total liability to you for any claim will not exceed the greater of (a) what you paid Bizbie in the 12 months before the claim and (b) $100 CAD.
Nothing in these Terms excludes liability that cannot be excluded by law.
18. Indemnity
You agree to indemnify Bizbie against claims arising from Your Content, your breach of these Terms, or your misuse of the Service, except to the extent caused by our own negligence or wrongdoing.
19. Suspension and closing accounts
We may suspend or close your account if you break these Terms, if the law requires it, or if we discontinue the Service. You can close your account at any time from your account settings. Closing an account does not cancel obligations that already exist, such as payment for completed purchases.
20. Changes to these Terms
We may update these Terms. We will give at least 30 days' notice of material changes by email or in the Service. If you keep using the Service after the changes take effect, you accept the updated Terms.
21. Governing law and disputes
These Terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Subject to your rights under consumer protection law, the courts of Alberta have exclusive jurisdiction over disputes.
22. General
If any part of these Terms is unenforceable, the rest still applies. If we don't enforce a provision, that doesn't waive it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
